Terms of Service

Welcome to Crumbs. These Terms of Service ("Terms") govern your use of the Crumbs mobile application (the "App"), operated by Crumbs Market Inc. ("Crumbs," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Crumbs. By using the App, you represent that you meet this requirement.

2. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You agree to provide accurate information (including your name and email) when creating an account.
  • We may suspend or terminate accounts that violate these Terms, engage in fraud or abuse (including referral program abuse), or misuse the App.

3. Crumbs Is Not a Bank or Financial Institution

Crumbs is a deal-discovery app. We are not a bank, money services business, or financial institution. We do not hold, transmit, or have access to your funds. Crumbs currency ("crumbs") earned in the App has no cash value, is not redeemable for cash, and is not a security, deposit, or financial product. Crumbs balances may be modified, reset, or discontinued at our discretion, including if the App or a related feature is changed or shut down.

4. Deals, Promo Codes, and Savings Estimates

This section is important — please read it
  • Where these come from. Promo codes and deals shown in the App are pulled from publicly available coupon and deal listings. Crumbs doesn't create or issue these codes and isn't affiliated with the merchants offering them.
  • Not independently verified. We don't test every code before it's shown. A code that worked recently may have expired, hit a redemption limit, or been restricted to certain items, regions, or new customers only.
  • No guarantee. Crumbs can't guarantee any code will work at checkout, or that any savings estimate (including any "Saved" total shown in the App) reflects the actual discount or price you'll receive. Always confirm the discount applies before completing your purchase.
  • Terms vary by merchant. Discounts, minimums, exclusions, and expiration dates are set by the merchant, not Crumbs. Check the merchant's site for full terms.
  • No liability for third-party sites. Using a code or deal may redirect you to a third-party website. We are not responsible for the content, accuracy, security, or practices of third-party sites, and your use of them is subject to that site's own terms and privacy policy.

By using Crumbs, you acknowledge that deal accuracy and code validity are estimates and are not guaranteed by Crumbs.

5. Location and Notifications

Location-based features and deal alerts are optional and require your permission. You can enable or disable these at any time in Settings. Disabling them may limit certain features.

6. Referral Program

Referral rewards (e.g., crumbs earned for inviting a friend) are subject to fraud monitoring. Crumbs reserves the right to withhold or reverse referral rewards obtained through fraudulent, abusive, or automated means, and to modify or end the referral program at any time.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or to violate any applicable law
  • Attempt to reverse-engineer, scrape, or interfere with the App's operation
  • Abuse the referral program or attempt to manipulate crumbs, streaks, or offer redemptions
  • Misrepresent your identity or provide false account information

8. Intellectual Property

Crumbs, The Sweeper™, Crumb Math™, and associated logos and branding are trademarks or pending trademarks of Crumbs Market Inc. The App's design, content, and underlying technology are owned by Crumbs or its licensors and may not be copied, modified, or distributed without permission.

9. Disclaimers

THE APP AND ALL DEALS, OFFERS, AND SAVINGS ESTIMATES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY DEAL, CODE, OR SAVINGS FIGURE WILL BE ACCURATE OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRUMBS AND ITS OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO A PROMO CODE NOT WORKING, A DEAL BEING UNAVAILABLE, OR A DISCREPANCY BETWEEN AN ESTIMATED AND ACTUAL SAVINGS AMOUNT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED $100 USD.

11. Dispute Resolution

Agreement to Arbitrate. Except as set out below, you and Crumbs agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App will be resolved through binding, individual arbitration rather than in court, except that either party may bring an individual claim in small claims court as described below.

Class Action Waiver. You and Crumbs agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, or representative action. Neither you nor Crumbs may bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding.

Small Claims Carve-Out. Notwithstanding the above, either party may bring an individual claim in small claims court (in the county/jurisdiction where you reside, or another mutually agreed location) instead of arbitration, provided the claim qualifies under that court's monetary and subject-matter limits.

How Arbitration Works. Arbitration will be administered by the American Arbitration Association (AAA) under its consumer arbitration rules then in effect. The arbitration will take place in Los Angeles County, California, or may be conducted remotely/by phone where permitted by the administering rules. The arbitrator's decision will be final and binding, subject to any limited review available under applicable law.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to save@crumbsjar.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the courts of Delaware, and the class action waiver above will not apply to you.

Governing Law. These Terms are governed by the laws of Delaware, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise.

12. Changes to the App or These Terms

We may modify, suspend, or discontinue any part of the App (including crumbs, streaks, or specific features) at any time. We may update these Terms; continued use after changes take effect means you accept the updated Terms.

13. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or for any other reason, with or without notice.
